Section 121

$250k / $500k of primary-residence gain is tax-free

If you owned and lived in the home as a primary residence for at least 2 of the last 5 years, you can exclude up to $250,000 of gain (single) or $500,000 (married filing jointly) from federal capital gains tax — and Colorado mirrors the federal exclusion. For most Coloradans selling a long-held home, this exclusion wipes the tax bill entirely.

Federal long-term cap gains is bracketed by your other income

Long-term gains aren't a flat rate. They sit on top of your other taxable income and fall into 0%, 15%, or 20% brackets. A retired couple with $50k of pension income and a $200k taxable gain pays a much lower effective rate than a dual-income tech couple with $400k of W-2 income.

Colorado has a flat state tax on the same gain

Colorado conforms to federal rules and applies its 4.40% flat income tax to whatever gain remains taxable after Section 121. There's no separate state-level capital-gains exclusion. High earners may also owe the 3.8% federal Net Investment Income Tax on top — we surface that automatically when income crosses the threshold.
